Reproductive Rights



In recent years, women's reproductive rights in America have faced significant challenges and changes. Several states have enacted restrictive abortion laws, including near-total bans and limits on when abortions can be performed, often without exceptions for rape or incest. These actions have been supported by a conservative shift in the judicial system, most notably with the Supreme Court's 2022 decision to overturn Roe v. Wade, which had protected the constitutional right to abortion for nearly 50 years. This ruling has led to a patchwork of laws across the country, where access to abortion services now varies drastically by state, leaving many women in certain areas with limited or no access to necessary reproductive healthcare. The debate continues to intensify, with ongoing legal battles and political efforts aimed at either restoring or further restricting reproductive rights.


Prop 139

Understanding Arizona’s Proposition 139 and Its Impact on Women 

This November, Arizona voters will decide on Proposition 139, a new law about abortion. If it passes, it will give women the right to an abortion up until a certain point in pregnancy, known as "fetal viability." This means the time when a fetus can survive outside the womb. Proposition 139 would change the current law, which allows abortions only up to 15 weeks of pregnancy, by extending access until fetal viability. The government wouldn’t be able to interfere in this decision unless it’s for a serious health reason. 

Why Does This Matter for Women? 

Personal Freedom: At its core, Prop 139 is about allowing women to make their own choices regarding their health and bodies. The proposition would provide more flexibility for women to make deeply personal decisions about pregnancy and abortion based on their life circumstances, rather than being limited by the government. 

Health and Safety: For many women, the decision to seek an abortion is related to their health, financial stability, or personal circumstances. By restoring rights that existed before the Supreme Court’s decision to overturn Roe v. Wade in 2022, Prop 139 allows women to make the best choices for their health in consultation with their doctors, without political interference. 

Family Planning and Life Decisions: Limiting access to abortion can affect many aspects of a woman’s life, including her ability to plan her family, career, and education. With Prop 139 in place, women would have more time and options to consider what is best for them and their futures. 

 

Why It Affects Arizona Specifically 

Abortion laws are being decided state by state Since Roe v. Wade was overturned. Prop 139 would place Arizona in line with other states that have moved to protect abortion rights, such as California and Michigan. It would ensure that Arizona women maintain access to reproductive care they had before the Supreme Court decision. Without these protections, many women are faced with limited options especially if they can’t afford to travel to a safe state. 

 

A Pivotal Moment for Arizona Women 

Proposition 139 offers Arizona voters the chance to make a lasting decision about reproductive rights. As this debate continues to unfold across the country, the outcome of this vote will determine whether Arizona will restore protections for women’s healthcare decisions or maintain the current restrictions. For many women, this decision represents much more than a political issue—it’s about safeguarding their rights, health, and future.

On April 9, 2024, the Arizona Supreme Court upheld an 1864 law that prohibits abortion unless the woman’s life is in danger. This made abortion illegal in Arizona, effectively repealing the existing Arizona law that allowed abortion up to 15 weeks.
